Terms of Use

These Terms of Use (“Terms”) govern your access to and use of turbosurfacing.com (the “Site”) and any services, estimates, content, or functionality offered through it (collectively, the “Services”) by Turbo Surfacing Solutions (“we,” “us,” or “our”), a licensed California State Contractor based in Chula Vista, California serving San Diego County. By accessing the Site, requesting a free estimate, or otherwise using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site.

1. Eligibility

You must be at least 18 years old and capable of entering into a binding contract under California law to use the Services or request an estimate.

2. Estimates & Project Engagements

Information on the Site (pricing ranges, cost calculators, ROI tools, timelines, square-footage coverage) is for general information only and does not constitute a binding offer. All work is performed only under a separate written contract that meets California Business and Professions Code §7159 (Home Improvement Contract) requirements where applicable. Final pricing depends on site conditions, materials, permitting, and scope confirmed in writing.

2.1 Contractor’s License

Turbo Surfacing Solutions is licensed by the California Contractors State License Board (CSLB). License status can be verified at cslb.ca.gov.

3. Acceptable Use

You agree not to:

• Use the Site for any unlawful, fraudulent, or harmful purpose;
• Scrape, copy, or republish substantial portions of the Site without written permission;
• Reverse-engineer, disassemble, or interfere with the Site or its security;
• Submit false, misleading, or third-party information without authorization;
• Upload viruses, malware, or other harmful code.

4. Intellectual Property

All content on the Site — including text, graphics, logos, photos, videos, project galleries, cost data, the “Turbo Surfacing Solutions” name and marks — is owned by or licensed to Turbo Surfacing Solutions and protected by U.S. and international copyright, trademark, and other laws. You may view and print content for personal, non-commercial use only. All other use requires our prior written consent.

5. User Submissions

If you submit photos, project details, reviews, or other content, you grant Turbo Surfacing Solutions a worldwide, royalty-free, perpetual, non-exclusive license to use, reproduce, modify, and display that content for marketing, portfolio, and operational purposes. You represent that you have the rights to grant this license.

6. Third-Party Links & Services

The Site may link to third-party websites, products, or services (e.g., Google Maps, payment processors, certification bodies). We are not responsible for the content, policies, or practices of those third parties.

7. Warranty Information & Disclaimer

Workmanship and material warranties applicable to installed projects are described in our separate written contract and the manufacturer’s documentation. EXCEPT AS EXPRESSLY PROVIDED IN A SIGNED CONTRACT, the Site and all content are provided “AS IS” and “AS AVAILABLE,” and Turbo Surfacing Solutions disclaims all warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY CALIFORNIA LAW, TURBO SURFACING SOLUTIONS AND ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY ARISING FROM OR RELATED TO THE SITE (SEPARATE FROM A SIGNED CONSTRUCTION CONTRACT) WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow these limitations; portions may not apply to you.

9. Indemnification

You agree to defend, indemnify, and hold harmless Turbo Surfacing Solutions from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, your misuse of the Site, or your infringement of any third-party right.

10. DMCA Notice

If you believe content on the Site infringes your copyright, please send a notice meeting DMCA requirements (17 U.S.C. §512) to our designated agent at info@turbosurfacing.com with the subject line “DMCA Notice.”

11. Governing Law & Venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Subject to Section 12, the exclusive venue for any dispute is the state and federal courts located in San Diego County, California, and you consent to the personal jurisdiction of those courts.

12. Dispute Resolution & Binding Arbitration

Please read this section carefully — it affects your legal rights. Except for claims arising under a signed construction contract (which are governed by that contract) and small-claims matters, any dispute relating to the Site or these Terms shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration will take place in San Diego County, California. You and Turbo Surfacing Solutions waive the right to a jury trial and to participate in a class action. You may opt out of this arbitration agreement by emailing info@turbosurfacing.com within 30 days of first accepting these Terms with the subject line “Arbitration Opt-Out.”

13. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including violation of these Terms.

14. Changes to These Terms

We may modify these Terms at any time. Updates take effect when posted to this page. Your continued use of the Site after changes constitutes acceptance of the revised Terms.

15. Severability & Entire Agreement

If any provision is held unenforceable, the remaining provisions remain in full force. These Terms, together with our Privacy Policy and any signed construction contract, constitute the entire agreement between you and Turbo Surfacing Solutions regarding the Site.
